Ex-FBI lawyer to plead guilty to falsifying Russia probe email; Ninth Circuit strikes down California gun magazine ban

There were two huge national  news stories on Friday.

 

The first was that ex-FBI lawyer Kevin Clinesmith will plead guilty to falsifying an email in the FBI's Russian collusion investigation. Here's what the New York Post said:

 

"An ex-FBI lawyer will plead guilty to doctoring an email that led his agency to wiretap a former Trump campaign adviser, officials said Friday — which the president claimed is clear proof he has been “spied on.”

 

"Kevin Clinesmith will cop to lying, which helped lead to a renewed wiretap of Carter Page, his lawyer confirmed — in what will be the first guilty plea produced by special prosecutor John Durham’s probe of the Russia investigation."

The second story is that the Ninth Circuit U.S. Court of appeals (yes, that's the one in California) said that California's ban on gun magazines that hold more than 10 rounds is unconstitutional.

 

 

 

“Even well-intentioned laws must pass constitutional muster,” appellate Judge Kenneth Lee wrote on behalf of two of the three judges on the panel. “California’s near-categorical ban of (large-capacity magazines) strikes at the core of the Second Amendment, the right to armed self-defense. Armed self-defense is a fundamental right rooted in tradition and the text of the Second Amendment.”
